Pacaso, created by a group of former Zillow execs, is a tech-based marketplace that connects luxury real estate buyers and sellers to facilitate affordable co-ownership of second homes in the most desirable locations around the world. They have initially brought co-ownership opportunities for homes and condos in Kapalua and Wailea, but are expected to acquire other luxury residences around Maui soon. This co-ownership model essentially breaks the ownership of the property into quarters, with each owner being given three months. 2 months are selected throughout the year and one month each for the most desirable months in the winter.  So, if you are really only able to spend 2-3 months in your Maui vacation home and you’re not looking to rent your property for rental income when you are away, it could be an attractive and convenient alternative to a traditional purchase. What Pacaso on Maui Does for Buyers Pacaso has a very interesting co-ownership model that enables buyers to purchase a quarter to a half of a condo or home instead of paying for the entire property. These may be contemporary homes or luxury condos for sale in Wailea or in other prestigious locations across Maui. The condos and homes that are listed for sale are high-end with a sales price that equals or exceeds four times the median value of homes on Maui. Thanks to the co-ownership structure the homes sold through Pacaso on Maui have occupancy for close to 90 of the year. Pacaso purchases the homes initially, and they are resold in fractional ownerships. Through Pacaso, up to four separate buyers may purchase fractional ownership in a property. Innovative Financing Pacaso also has an innovative financing model that currently offers a very attractive rate sheet. At 50 down, a buyer can capitalize on a loan 3.5 interest on the other 50, even while national second home interest rates are above 6. They offer a 10-year ARM with no prepayment penalty. You could also choose to work with a local Maui lender to finance the deal too. The Impact on the Community Thanks to Pacaso’s innovative system, many people who may not have been able to enjoy a luxurious lifestyle in their own Maui home or condo can now live that experience. In the process, they can positively contribute to the local economy. However, Pacaso will do more than bolster Maui’s economy. Pacaso has graciously supported Puko’a hina’ole, which is the island’s exclusive water quality lab. Its support was initiated with a $10,000 donation. This will grow with additional donations made for each home that is purchased through the Pacaso system. The lab, which was established in 2020, focuses on research, education, and community health, and it is affiliated with the University of Hawaii.  Its objectives are to promote great water quality for Maui’s residents and to protect the coral reefs throughout the state.   The Benefits of Co-Ownership  Furthermore, Pacaso on Maui may minimize waste and ensure optimized use of condos and homes on Maui. Specifically, many second homes around the world are only occupied for a few months of the year. Some of these homes are used as short-term rentals for the remainder of the year. However, many of Maui’s elite communities specifically forbid the use of homes as rentals. This means that these second homes would sit idle for months of the year when they otherwise could be enjoyed fully by multiple owners. Through Pacaso’s fractional ownership structure, real estate use on the island is optimized. This is true for many other luxury communities throughout the United States, and Pacaso is also active in some of these other markets.  Generally, fractional ownership of homes and condos is not permitted on the island. However, Pacaso’s unique system enables it to bypass the established, related laws for the benefit of potential homebuyers. Some local residents have expressed concern about the impact that Pacaso’s activities may have on the affordability of homes in the area. After all, the real estate market is tight across all price points. However, Pacaso states that its activities will not impact housing affordability because it exclusively operates with high-end homes that are offered for sale far above the median home price on the island. How Pacaso Works Many real estate agents like myself have clients with high standards as they search for luxury homes or condos in Wailea and other luxury areas of Maui. However, some of these clients have been priced out of the homes that live up to their expectations because of Maui’s extraordinary housing market. Pacaso on Maui enables us to help our clients find a second home that they will love.  Luxury homes and condos are initially purchased by Pacaso and are placed in an LLC. Buyers can search through a range of premium listing options. Once they find something that they are interested in, they can purchase a share of ownership for the LLC that owns that particular home. Specific details, such as access dates are predetermined in the LLC documents. Pacaso will not have any ownership interest in the property after the transaction has been completely finalized. Title : Market Perspective: Is The National and Local Real Estate Market Shifting?
Description : Broader US Market Conditions And How They Affect Maui It’s no secret that property values and prices on Maui have increased at an astronomical rate since interest rates were slashed in 2020 during the pandemic. While properties on Maui typically appreciate slightly faster than most other markets, a similar vertical pricing trajectory has been happening across the country. Even today, we are still in one of the hottest seller’s markets in history. Fortunately for buyers, there are some indicators at the national and local levels that the market is shifting slightly and should begin to level out. The clickbait stories in the national media want us to believe that we are in a housing bubble, but how likely is it that home prices could actually be lower in the next year than they are today? Has The Market Peaked? While major indicators are showing signs of a real estate market slowdown, many experts are not expecting a decline in home values. In fact, you may expect a more modest level of continued growth in home values. Keep in mind that home prices are still soaring. In fact, as of April 2022, the year-over-year median sales price was up 14.8 nationally, according to the National Association of Realtors. The median sales price of existing homes in the US topped $391,000 at that time, which was an all-time high. On Maui, our median residential single-family home price is 1.2M, 3 times the national average, and a 27.4 increase from the previous year and our median price of all properties was 872k in May of 2022. Low supply and high demand are still driving the market. Until there is approximately two to three times the number of properties for sale at any given time, prices will continue to rise and we can't foresee any event that would create this scenario in the short term. Rising Interest Rates Are Designed to Cool The Market As you know, the Federal Reserve is responsible for steering monetary policy in the United States. One of its primary tools for doing so is adjusting the federal funds rate. This is the interest rate for credit unions and banks when they lend money to each other. By raising the interest rate, the Federal Reserve essentially clamps down on the free flow of money. The banks and local lenders, in turn, increase their interest rates for consumers. Recently, the Federal Reserve’s interest rate has been bumped up to 1. It was at 0 as recently as March 16, 2020. Several more rate increases are projected throughout the remainder of 2022. These increases are in direct response to inflation. The inflation rate in the U.S. hit 8.3 in April 2022, which is close to a 40-year high. The hot housing market has been one of the many driving factors for the increase in inflation. Where Will Rates End Up? As a result of the Federal Reserve’s recent change in monetary policy, the average interest rate for a 30-year mortgage is now higher than 5.3. It was below 3 for much of 2020. When interest rates are low, homebuyers can more easily afford higher-priced homes. While home prices have been escalating rapidly in recent years, the lower interest rates enabled buyers to absorb those increases. Now that interest rates are higher and are projected to increase further, however, affordability is increasingly a concern for buyers. This is magnified by the fact that real estate prices have continued to rise thus far. The Fed has indicated at least a couple of more quarter-point increases are on the way over the next year, but they seem intent on balancing the needs of the economy by doing this slowly and based on broader economic news, especially from retail sectors.  Balancing Affordability With Demand Home affordability is an increasing concern in many real estate markets across the country. When buyers simply cannot afford the mortgage on a new home, sales slow. As a result, the median sales price of existing homes will gradually even out. Essentially, the rising interest rates will flatten sales prices to keep affordability in check. If interest rates rise too much, however, sales prices in some markets may decline. The Federal Reserve strives to maintain a reasonable level of economic growth, so it keeps a close eye on the real estate market. If home prices decline, you can expect the Federal Reserve to adjust its monetary policy accordingly to promote economic health. With this in mind, rising interest rates will serve to stabilize home prices. However, growth, albeit more modestly than in the last two years, in real estate prices is expected to continue.     (Slightly) Slowing Real Estate Sales There are many factors that drive real estate sales. For example, home prices in many markets have risen so sharply over the last few years that wages have not kept pace. The net effect is that housing affordability has actually declined in markets across the country. When people cannot afford the sales price of a new home, sales will naturally decline. Essentially, home prices cannot continue their breakneck pace upward indefinitely.  Interest rates also impact affordability. When interest rates rise, the upper sales price limit that a buyer could afford declines. In this way, interest rates can rein in sales prices so that they are more aligned with what buyers can afford. It is important to note that affordability is also affected by the cost of living. Rising inflation has been spurred by rising food and gas prices as well as price increases for cars and other goods. Inflation has hit all markets across the country. In some cases, it has added a few hundred dollars or more to a person’s monthly expenses. This impacts the amount of money that is available for housing each month. Some of those who may have otherwise been planning to buy a home in the near future may no longer be able to afford to do so. A Slight Increase in Listings is a Great Sign These effects on home sales are already evident. In fact, as of April 2022, home sales have declined, even if slightly,  for four straight months. Many homeowners have continued to list their homes for sale over the last few months. Because there is a general fear among some homeowners that they could miss out on the opportunities presented through the hot real estate market, many have decided to jump into the market. A positive indicator for buyers is that, as of May 26, 2022, listings jumped 9 in one week compared to the same time last year. At the same time, however, the number of signed sales contracts has declined. In April 2022, pending home sales were 4 lower than the previous month and 9 lower from a year ago. Be aware that this increase in listings may be short-lived as the market continues to cool. Months Supply of Homes Going Up Nationally, Not Yet Locally The key metric and major indicator that the market is leveling out will be 'months supply of homes'. This basically says that in any given real estate market, if no new inventory were to become available, the existing inventory would sell in this number of months. Prior to the pandemic that number was around 6 months, at its low, this number was around 1 month. The supply of homes on the national market has recently increased overall. This is a product of buyers being a little more discerning about what they offer and how aggressive they go. In January 2022, the supply of homes for sale was 1.6 months. However, this is now increased to 2.2 months. As interest rates rise and affordability increasingly becomes a concern, the supply of homes available is expected to increase further. This is a sign of a more balanced real estate marketplace, it does not indicate that a housing market bubble is about to burst or that there was ever a bubble, to begin with. It is important to note that the supply of homes describes both existing homes and new construction homes. In many areas, rental rates have increased dramatically as well. This means that both buying and renting are increasingly unaffordable for many people. To combat this problem, some areas have tried to increase the supply of new homes. One way that they have tried to do this is by easing building restrictions. While this does not apply to all markets, it has a direct impact on supply in specific areas. Supply Chain Issues Supply chain issues that have been directly caused by the COVID-19 pandemic have impacted construction as well. In fact, in some markets, builders struggled to keep up with demand over the last year. Some builders had waiting lists for their homes. While supply chain issues continue today, they have eased slightly. This has resulted in a more reasonable supply of new-construction homes in some markets. As the demand for homes continues to wane, this supply is expected to increase. When the supply of homes in a market increases, prices will naturally level off. There may be fewer bidding wars, and many homes may sell for the asking price. If supply continues to outpace demand, buyers may be in the position to offer less than the asking price. Homes may also remain on the market for a longer period of time, and this may drive some sellers to consider making seller concessions. If the housing market becomes extraordinarily saturated with listings of new and existing homes, there is the potential for listing prices to decline overall. However, there are many factors in place that may make this highly unlikely. For example, the Federal Reserve can respond to oversaturation in the market by adjusting interest rates. In addition, as prices level out, the demand among buyers may stabilize. The Future of the US Real Estate Market The housing market crash that started with the Great Recession of 2008 had harsh impacts on millions of people, such as through foreclosures and short sales. As a result, today’s homeowners understandably are concerned about the possibility of a repeat event. While there is always a chance that home prices could plummet in the near future, the reality is that this is unlikely. Consider, for example, that the previous housing market crash was the result of extremely lax lending standards along with regulatory oversight. Many homeowners were granted mortgages that they could not comfortably afford. Others were given adjustable-rate mortgages that became unaffordable as interest rates increased. Since that time, lending standards have dramatically improved. For example, there are stricter debt-to-income ratio requirements in place, and zero-down mortgages are generally only available through the USDA and VA loan programs today. The Influence of the Federal Reserve  In addition, the Federal Reserve meets eight times each year. Prior to each meeting, it carefully analyzes all aspects of the national economy. The housing market is influenced by other sectors of the economy, including inflation, unemployment, and more. With this in mind, the Fed’s well-rounded approach to making interest rate adjustment decisions will help the housing market to come in for a soft landing. If signs of a pending crash are identified, the Fed will undoubtedly make rapid adjustments as a preventive measure.  Interest rates and lending policies undoubtedly play a major role in the future of the US real estate market. This is because they impact demand. Supply is also a key factor that impacts the market. When supply far outpaces demand, housing prices may level off and eventually decline. However, a sharp increase in supply is unlikely. As housing prices cool off, some sellers may be less inclined to list their homes for sale.  However, the availability of new-construction homes may increase in the near future. This is because of expected easing in the supply chain for building materials and the increase in interest rates. With this in mind, supply and demand are expected to become more aligned. As a result, the health of the market may improve overall. What We Can Expect Whether you plan to buy or sell a home in the months ahead, you understandably need to know what to expect. Many buyers are rate-sensitive. If you are buying a home, you may be inclined to make an offer sooner rather than later in order to lock in a great interest rate. If you are selling a home, you may be inclined to list your home for sale soon before the market cools off and still have a chance at inciting a bidding war. While these are reasonable motivations, it is important to note that the market is expected to find a level of equilibrium in the near future as all of these various factors leave their mark. Description : An Owner's Guide To Self-Managing Your Own Airbnb Managing a short-term rentable condo on Maui is a great way to earn passive income on a property and have a second home in paradise at the same time. Most of our clients that purchase these types of properties are from the US mainland or Canada and use a local property management company to ensure everything runs smoothly. While there are many benefits to using a property management company, there are some who elect to manage the unit themselves with great results. However, managing an Airbnb when you can't consistently visit the property to make sure it's in good shape can be difficult, but it can be incredibly profitable once you have a system in place. Here are some useful tips I’ve discovered from my experience in the business for managing your short-term vacation rentable unit remotely.  1. Marketing and Monitoring Prices For this investment to work out for you, it’s critical that you ensure that you’re getting the highest possible occupancy rate while charging current market prices. Many self-managers don’t monitor market prices of comparable units and will still be advertising rates well below what they could be getting. Staying on top of prices is one half of the equation, the other half is making sure you’re listing is turning heads online.  Get Professional Photos and Videos There are thousands of available properties for rent in any given market, especially the Maui rental market. Make sure your listing speaks of professional management and shows why your unit is the one to book. Get professional photos of all main parts of the unit, showcase the view if it has one, and make sure you include pictures of the amenities at the complex. Many go as far to make a video with a virtual walkthrough to really give guests an inside look into what it would be like to spend a week in your unit.  Reviews Drive Sales From the beginning, be committed to providing outstanding service and always request reviews for your unit from every client. If you’ve purchased a home or condo from me, you know I always request reviews. You can even read mine here. Reviews are the social proof of the 21st century and let other possible clients know what your previous clients think about you. You don’t need to pester your clients. All you need to do is provide service that is above and beyond and when they check out, send them a thank you note for staying along with a couple of links to make the process easy for them. We’ve all decided against or for a purchase based on reviews and in a competitive landscape like Airbnb, you’ll want to get those great reviews 2. Use Tech to Manage Access You can't be everywhere at one time, so you need to get your guests a key to the house somehow. Ideally, you could hire someone to handle this for you, but you'd be responsible for paying for their travel, which could get expensive. Instead, you can offer a self-check-in or key management service by using smart locks or smart key safes.  With a smart lock, you can put a pin padlock on the door and make it accessible by app only so only you can create a pin for guests. Additionally, you can put a key safe on the door lock and control it with an app. This option is not a lock itself, it's a safe that contains the key to the property.  Nothing is worse than a guest getting locked out without a backup key readily available. With a keypad or app-based entry, you’ll be able to make sure your guests are taken care of and this contingency never happens. 3. Management and Accounting Software You'll want some management software to automate as many of your recurring tasks and communications as you can. Keeping everything organized is paramount to keeping guests happy and making sure the county and state get their taxes paid on time. Management software can offer guest communication, availability calendars, reservation management, and online payments to allow guests to book their own stays easily and keep your involvement at a minimum. Lodgify offers a nice solution.  There are a variety of expenses and associated taxes with owning a short-term rentable condo on Maui. Beyond paying property taxes, you’ll be paying GE tax as well as Transient Accommodation Tax. You’ll need to pay your monthly HOA, the electric company, and other service providers.  4. Cleaning Services After every guest checks out, you'll need to clean the unit and prepare for your next guest. However, you can't clean the property yourself when you're managing remotely. Instead, you can hire a professional cleaning service that will handle routine tasks after your guests leave, including cleaning and organizing, disinfection, and refilling toiletries. Many cleaning services specialize in short-let rentals, such as AirBnbs. If you would like a referral for this task, just give me a call at 808-214-4799 and I’m happy to share my list with you. Your cleaner will also most likely be your required on-island point of contact on the island, required by the county for off-island owners. That will be a pivotal relationship in your success.  5. Repairs and Maintenance You'll need to have repair and maintenance contacts available any time of day to take care of emergencies. All properties require some level of maintenance, so it's important to be able to serve your guests to provide them with a quality experience even when something goes wrong. As a landlord, you must ensure that problems are resolved timely, and your guests expect this of you. Anything less than the best service will result in a negative review that hurts your bottom line. Hiring a professional maintenance team that's able to respond to issues any time of day is imperative. Your maintenance team should consist of: Electrician Plumber Handyman  Pest control service You can also invest in a service that will take care of maintenance and problems pertaining to the property for you. Instead of dealing with coordinating multiple people, a company will take care of hiring professionals and ensuring your AirBnb is properly taken care of.  6. Security Cameras As a host, you must tell guests if you have any security cameras in the home. Having cameras in the home may prevent your property from getting booked, so it's typically best to keep them outside so you can monitor guests coming and going instead of what they're doing inside the home. While it might not sound useful to watch guests come and go, it can be helpful to ensure guests and checking in and out on time. Plus, as a great host you should respect your guest’s privacy.  7. Provide a Welcome Package Airbnb is all about providing a quality service that's better than anything guests could get at a boring hotel. Providing a welcome package is a great way to introduce yourself without the need to be there to hand your guests the key. Your welcome pack should provide: A nice welcome note House rules Trash disposal instructions Information about local attractions  Emergency contact numbers Information about the property, such as WiFi password, how to use the appliances, etc. 8. Be Available Even though you can't pop in whenever your guests need something, you should remain available. You can expect a few late-night messages or calls from guests with emergencies, so it's important to pick up the phone or give them information on who to contact via your voicemail recording. During the day, guests will expect to be able to contact you directly and not have to call anyone else. By being available, you can provide them with a quality experience to get good reviews and start booking more guests.  A Successful STR Investment Should Pay Your Bills (And Then Some) There are many ways to reduce your mortgage costs, but vacation renting can typically cover all of your payments. We find that with 30-40 down, you should be at break-even or above based on historical data and current clients' data. As rates begin to tick upwards after the historical lows of the last couple of years, you’ll certainly want to stay in tune with home loan interest rates. Many mortgage lenders on the mainland will not finance short-term rentable properties on Maui, also known as condotels. You really do need to work with a local Maui lender to get the loan approved and I can provide a list of my top lenders easily upon request. Maui recently banned renting single-family residences on a short-term basis and the consequences for breaking this law are pretty severe. Many markets on the US mainland and in Canada still allow for this practice though. If you’d like to discuss any of these aspects of self-managing an STR, feel free to give me a call to discuss. Final Thoughts Managing AirBnbs by yourself without being physically present can sound overwhelming, but with these tips, you can allow guests to check themselves in and learn about the property and your rules on their own. The venue has a farm-like feel with umbrella-covered tables on a lovely deck. From its perch in the hills, Hana Harvest delivers lovely views of the ocean. This restaurant offers espresso shots, Americano coffee, lattes, mochas, and more. In addition, its menu includes fruit smoothies, wood-fired pizzas, ice cream, sandwiches, and other types of cafe fare. Jaws Country Store Jaws Country Store has a surfer shop vibe with both indoor and outdoor dining areas. Surrounded by a lush, tropical landscape, the venue is known for its dishes made with fresh, organic ingredients. Jaws Country Store specializes in select coffee drinks, including lattes, cappuccinos, and Americano coffee. Both breakfast and lunch dishes are available as well. Title : What's Going On With Wailea 670 | The Honua'ula Project
Description : Where Are Things with Wailea 670? Originally referred to as Wailea 670, the development that is now known as Honua'ula is more than three decades in the making. This is a mixed-use development that would span across 670 acres in South Maui. This area, which is located just south of Maui Meadows and across the highway from the existing Wailea community, is both culturally and environmentally sensitive. While opponents of the development say that the project is not advantageous for the communities, others say that it will provide much-needed affordable housing to the area. Recently, a major agreement has been reached as a result of years of stressful negotiations, but more negotiations are underway. Balancing The Environment with Housing Needs Previously, the development plans included approximately 1,400 units of single-family homes and multi-family units. In addition, the development included plans for commercial spaces and a golf course. The environmental and cultural impacts of such a large development in this strategic area were introduced by notable groups like Maui Unite and Sierra Club. Negotiations have been between these organizations, the County of Maui and Honua'ula Partners, LLC. While the initial development plans provided accommodations for culturally and environmentally sensitive areas, the claim introduced by Maui Unite and Sierra Club contended that the accommodations did not go far enough to fully address the situation. After the claim was made, the developer agreed to complete more archaeological and environmental studies in the area. Among other relevant factors, the findings of these studies indicated that this 670-acre parcel of land had several hundred important historic features and sites. The archaeological findings included the identification of ancient farming terraces, living quarters, stepping stone trails, and ceremonial sites. Notably, many of the sites that were identified through the developer’s studies are now covered by perpetual protection. Affordable Housing A Necessary Consideration Another aspect of the claim was tied to affordable housing units. The claim specifically contended that the 250 affordable housing units that were initially required did not take into account environmental concerns. These units were projected to be built inside the Kaonoulu Light Industrial Subdivision, which is located in North Kihei. The settlement between these parties is encompassing. It includes an agreed-upon protected area of 160 acres. This area preserves both endangered and rare animal and plant species that are native to the area. It also safeguards historic lands that have been home to ancient Hawaiian villages and cultural sites. The extensive settlement agreement also reaches some areas of the historic Kanaio-Kalama Road. The eighteen-hole golf course that was originally proposed was dramatically reduced in size and has most recently been eliminated from design plans. Maintaining What We Love About Maui In addition, the Hawaiian Islands Land Trust will place a conservation easement on the protected lands. Both the general public and cultural practitioners will have specific rights to select areas. A large deer fence will be installed to protect wildlife from encroachment. This is in combination with a small public park located near a 116-foot-wide buffer boundary near Maui Meadows. There are now also height restrictions for structures that will be constructed near the buffer boundary. The history of this land's development is extensive. In the 1990s, zoning for this land was altered to accommodate the project. Wailea 670 was originally approved in 2008 by the Maui County Council with District Phase I Developmental Approval. At that time, the Maui County Council placed several development conditions on the project. These included preservation areas for both environmentally and culturally sensitive areas. One of the specific conditions was a native plant preservation area that was to be between 18 and 130 acres in size. In 2012, the EIS and the EA were accepted by the Maui Planning Commission. However, this initial approval was challenged by a claim that was filed in 2012. A Litany of Hurdles Left To Overcome During the negotiations surrounding this claim, the developers stated that Low Impact Design principles would be used. For example, the design includes the continued presence of existing gulches. An extensive network of bikeways and sidewalks would be incorporated into the design. This includes the placement of bike lanes in both directions on Pi’ilani Highway. This road will grow from a two-lane road to a four-lane road, but it will have roundabouts rather than turn signals at intersections. Additional negotiations included special requests for other streets throughout the development. The homes for sale in Wailea as well as the mixed-use commercial spaces would remain in place. Initially, affordable housing was to be located in North Kihei. Through negotiations, at least some of the affordable homes for sale in Wailea will now be located within the Wailea 670 development. However, others may still be located in North Kihei.  The specific price range of the homes and condos will be determined at a future date and will be based on affordable housing statistics. Both rental units and fee simple properties for sale will be included in the development. Approval for the units must be granted by the Maui County Council. While the two parties have come to many agreements through intense negotiations, it is important to note that the Maui Planning Commission must grant final approval for the settlements. Recent Developments For Wailea 670/Honua'ula In February 2022, the development group went in front of the Maui County Council once again to seek approval for the next phase of the Wailea 670 development. This time, two different groups stepped up to challenge the project. These groups are Maui Tomorrow Foundation and Hoʻoponopono O Mākena. The project has evolved substantially over the years. Currently, the proposed development includes 288 workforce housing units and an additional 861 residential units. Approximately one-quarter of the 670 acres would be permanently preserved by a conservation easement. Both of the groups that are currently requesting intervention with the development have stated that their interests near Wailea 670 would be directly impacted by the development. Maui Tomorrow also went a step further by claiming an insufficient number of affordable housing units and negative cultural and environmental impacts. A Tough Test for the Maui Planning Commission The Maui Planning Commission saw no opposition from the Honua'ula attorney. The attorney stated that the issues presented were straightforward and that he welcomed a closer examination of the facts. Contesting parties are required to present supporting evidence in front of the Maui Planning Commission. The developer’s attorney stated that they are forthright with all aspects of the development. The developer welcomes all questions that these groups have raised, and it has appropriate and comprehensive answers to those questions. During the session, supporters of the development stated that the project struck an appropriate balance between creating much-needed affordable housing in the area and preserving sensitive cultural and environmental areas. One group supporting the development is the Hawaii Community Foundation. On the other hand, opponents of the project stated that there are not enough workforce homes and affordable Wailea condos for sale in the current proposal. Opponents also believe that the project does not go far enough to address the potential impacts on sensitive areas. One individual opponent, who is a lineal descendent of the island’s native population, stated that simply following procedures was not the same as doing the right thing. We Are Still Years Away  Immediately after the conclusion of the commission’s session, mediation steps began. A contested case hearing got underway on March 22. If the parties can come to an agreement, the developer must then request District Phase II Development approval from the commission. Additional permits and approvals must also be obtained before the developer can break ground on the Honua'ula project. The extensive design and development of the Wailea 670 project have been revised many times over the years as different parties have raised their concerns related to affordable housing as well as sensitive areas. The project has progressively obtained approvals from different organizations and departments, including the Office of Hawaiian Affairs, the State Historic Preservation, the Maui County Council, and others. However, with another dispute pending, it is clear that more work needs to be done before the future of this project can be solidified. Description : What's the Difference Between Fee Simple and Leasehold Properties? In most areas of the United States, when you purchase property, you are buying the land and all of its improvements in perpetuity. However, this is not always the case in select states and vicinities. Before you buy real estate on Maui or in any other area, it is important to know exactly what your purchase includes and how long you will have access to that property. With this in mind, a closer look at the differences between fee simple vs. leasehold ownership is in order. Understanding Fee Simple Ownership Fee simple ownership, which may also be referred to as a freehold, is the type of real estate ownership that most people are familiar with. With fee simple ownership, you are buying the land and its improvements in their entirety. More than that, you will have direct ownership of the property until you decide to sell it. This is real estate that may be passed down to your heirs after your passing. The property owner may also execute a lease and grant the temporary use of the land and its improvements to another person or legal entity. Essentially, the owner can do as he or she wishes with the property with only a few exceptions. These exceptions are tied to local zoning ordinances, subdivision restrictions, and other such exceptions that are specifically linked to the land and that are known before the purchase takes place. How Leasehold Ownership Is Different Leasehold ownership stands far apart from fee simple ownership. Essentially, a fee simple owner enters into a leasehold agreement with another person. This agreement is generally far longer than a typical residential lease that you may be familiar with. It is common to find leaseholds that extend for 15, 30, or more years. The fee simple owner retains full rights to the land. The leaseholder buys rights to the improvements on the land, but he or she is leasing the land underneath those improvements. For this right, the leaseholder must pay the fee simple owner a monthly rent payment. Because of the extended length of a leasehold agreement, the rental payment amount usually is escalatory over time. The specific terms, however, can vary dramatically based on the terms of the agreement. In addition, the leaseholder must purchase the improvements on the land, such as through a mortgage. At the end of a leasehold, the fee simple owner has full control over the land and its improvements once again. Keep in mind that the leaseholder is not bound to the property for the entire length of the agreement. The leaseholder has the ability to sell his or her leasehold rights to another party. Regardless of who owns the property at the end of the leasehold term, however, the property will revert back to the fee simple owner. The Benefits of a Leasehold At first glance, the limited access to property rights with a leasehold may make this type of ownership unattractive. However, there are several important benefits of a leasehold that you should be aware of. For example, when you compare the cost of a fee simple vs. leasehold property, you may discover that the purchase price is far more affordable. A lower sales price generally equates to more affordable monthly payments. This means that the affordability benefit may continue for the length of your leasehold term. There is also a possibility that the fee simple owner will sell his or her fee simple ownership to you. If this happens, you will then have fee simple ownership of the property. The Drawbacks of a Leasehold Likewise, there are a few drawbacks to a leasehold that you should be aware of. The length of a leasehold is usually so long that the leaseholder will sell his or her interests in it well before the leasehold term expires. However, if you plan to hang onto the property, you will eventually be required to return the land to the fee simple owner. A leasehold agreement typically has a surrender clause. This means that all of the improvements to the land revert to the fee simple owner. It is also important to note that it can be increasingly difficult to sell a leasehold property as the end of the lease term approaches. One reason for this is because of a lack of available financing for a buyer. The Impact on Taxes and Mortgage Options Unless you plan to pay for your new property outright with cash, you need to know how your ownership interest in the property will affect your mortgage options. Many Maui lenders require the mortgage term to be shorter than the remaining length on a leasehold term. This means that if your leasehold term has 21 years remaining, you may only be able to qualify for a 20-year mortgage. If your leasehold term has 10 years remaining on it, you likely will not be able to refinance your mortgage. You also may only be able to sell to a cash buyer. In addition, your interest in real estate can impact your tax liability. Regardless of your ownership interest in the property, you may have access to several lucrative tax credits through depreciation. However, the IRS only views leaseholds with a term of 30 years or longer in the same light as a fee simple property. If the leasehold term is less than 30 years long, the property is considered personal property rather than real estate for tax purposes. Maui’s Leasehold Properties Now that you have a better understanding of fee simple vs. leasehold properties, you may be wondering how this will impact your property search. Several notable condominium communities throughout Maui are leasehold properties. For example, Ma'alaea is an area where leasehold properties are common. This includes the beautiful Ma'alaea Yacht Marina community. In addition, there are several leasehold properties in Ka'anapali, including Ka'anapali Shores and Maui Eldorado. Kihei is also home to several leasehold properties, such as Kamaole Nalu. The nuances of fee simple and leasehold properties can be complex, and they can have far-reaching impacts on everything from your usage of the property and its future salability to taxation, mortgage options, and more.
